UNDER AND BY VIRTUE of the authority contained in a certain Order entered by the Clerk of Superior Court for the County of Wilkes on the 16TH day of May 2024, in a special proceeding therein entitled TIMOTHY B. JOINES, Administrator CTA of GLENN W. BAILEY, Petitioner vs. JEFF KHLEIF et al, Respondents, as found in file 2023 SP 178, the undersigned Commissioner will offer for sale at public auction to the highest bidder for cash at 10:00 a.m. on the 24th day of July 2025, in the lobby of the Wilkes County Courthouse in Wilkesboro, North Carolina, SUBJECT TO THE CONFIRMATION OF THE COURT, that certain tract or parcel of land located in Union and Jobs Townships, Wilkes County, North Carolina, and more particularly described as follows:

BEGINNING on a large maple, corner of the Francis R. Quis land, running North 89 degrees 47" West 676.54 feet to an iron stake at a chestnut; thence South 0 degrees 52" West with the Bill Beshears line 1567.06 feet to a stake in a soil road; thence eastward with said road the following: South 41 degrees 03" East 124 feet; North 78 degrees 23" East 255 feet South 78 degrees 37" East 85.65 feet; North 78 degrees East 263 feet to a stake at intersection of another soil road; thence northward with the road the following: North 17 degrees 36" East 284.11 feet to a point in SR#1355; thence with SR #1355 the following: North 2 degrees 6" East 112 feet; North 19 degrees 44" West 289 feet; North 52 degrees 28" East 60 feet to a stake; thence North 1 degree East 888 feet to the beginning, containing 25.87 acres more or less and being a portion of the lands described in deed recorded in Book 518 at page 211 WCR.

This sale is subject to ad valorem taxes and such other liens as may appear of record.
The property to be offered pursuant to this notice of sale is being offered for sale, transfer and conveyance “AS IS, WHERE IS.” The commissioner makes no
representations or warranties relating to the title or any physical, environmental, health or safety conditions existing in, on, at or relating to the property being offered for sale, and any and all responsibilities or liabilities arising out of or in any way relating to any such condition expressly are disclaimed. THIS SALE IS MADE SUBJECT TO ALL PRIOR LIENS AND ENCUMBRANCES, AND UNPAID TAXES AND ASSESSMENTS. THIS SALE IS SUBJECT TO A BUYER’S PREMIUM OF 6% TO ADDED TO THE LAST AND HIGHEST BID, INCLUDING SUBSEQUENT UPSET BIDS.
NOTE: This sale will be in all particulars governed by the provisions of N.C.G.S. § 1-339.1, et. seq. A cash deposit from the highest bidder will be required of ten percent (10%) of the first ONE THOUSAND DOLLARS ($1,000.00) bid plus additional five percent (5%) of every ONE THOUSAND DOLLARS ($1,000.00) bid thereafter to be paid in cash or certified check to the commissioner conducting the sale. An upset bid shall be made by delivering to the Clerk of Superior Court, with whom the report of sale was filed, a deposit in cash or by certified check or cashier’s check satisfactory to the clerk in an amount greater than or equal to five percent (5%) of the amount of the upset bid, but in no event less than SEVEN HUNDRED FIFTY DOLLARS ($750.00). The deposit required by this section shall be filed by the close of normal business hours on the tenth (10th) day after the filing of the report of sale, and if the tenth (10th) day shall fall upon a Sunday or legal holiday or upon a day in which the Office of the Clerk is not open for the regular dispatch of its business, the deposit may be made on the day following when said office is open for the regular dispatch of business.
